My electricity company gave me a bill that was higher than it should be, I have questioned that bill. Does that make me guilty of something?

Guilt and innocence are concepts dealt with in the criminal courts. The examples of murder and fraud given above are criminal offences. Your guilt or innocence are determined in these matters.

A tax tribunal is dealt with in the civil courts. Civil courts do not deal with guilt or innocence.

If rfc lose the appeal they will be guilty of tax evasion because they will be deemed to have deposited salaries and not simply bonuses etc into EBTs. Certain types of payments such as certain bonuses can be paid into EBTs as tax avoidance and this is legal, but salaries cannot as this would be tax evasion. If rfc lose the case it is because the law Lords have ruled that salaries were paid in, not loans or anything else.

SPL and SFA will then have to decide how they punish rfc. Tax evasion means that HMRC will push for liquidation as this is their written policy as outlined by the insolvencey solicitor on RS the other night.
