100 Hours Community Service...

And a 2 year ban. For being caught drinking and driving a SECOND time. Is the court taking the plss? Sorry but he needs locking up, I don't care how many bloody England goals he's got. The courts had a great chance to send a strong message to ALL drink driving s here. Locking up Wayne Rooney for doing it would dam sure drive the message home that it WILL NOT BE TOLERATED! Even if you're a rich and famous nation's treasure.

The fact this is his second time for this offence, means the courts have now sent all the drink driving s out there, the exact opposite message. They've just told them all "Hey, you can get away with it at least twice before we'll lock you up so it's worth the risk." Yet again the justice system undermines itself and in doing so puts us all at risk. This is a particularly heinous offense which brings death and misery to hundreds every year.

Of ALL people Wayne Rooney has no need to drink and drive. He can afford a taxi to the other end of the country or a limo if he wants. For him to get in a car and drive when he's been drinking demonstrates his utter disregard for the lives and safety of other people.

"Well I can afford to pay for a taxi to Scotland if I want so can get one to her house. But no, feck the little people on the road and their lives. I'm gonna keep the money and drive plssed instead."

WWWHAT A PRIZE Who SHOULD be in a wagon on his way prison now. I hope the CPS appeals the sentence and a different judge gives him the jail-time a SECOND time offender should get instead of a first offence slap on the wrist.

Why should money be spent on them? Community service is much more useful for everyone than him going to prison and a ban from driving stops them

If we were talking about a far greater sums than the one his taxi fare would have come to maybe. But an appeal suggesting a currently active PL footballer had his wealth incorrectly assessed when it was adjudged that he could have afforded a taxi fair of £100 after a night out. Is one I would expect a court here to not even allow to be lodged due to having no merit. He's not filing for bankruptcy, if he was then that appeal might hold water.

You keep talking about Human Rights as though money has no effect on situations in people's lives. If his money and profile couldn't have helped him out of his situation and then he was locked up stating he could have used it. THEN you'd be infringing on his human rights. Because then you would be locking him up purely for being rich and famous.

I'm not suggesting a rewriting of guidelines to state "Lock a rich man up for longer" because again that would be a sweeping generalisation on statute which would see loads of people getting bigger sentences for crimes, where their money had no direct baring on the event or events leading up to it. Again that would be hr infringement.

I'm simply saying that in this particular case there his money and stardom did have a direct baring on his circumstance and situation. He CHOSE not to take advantage of that to avoid risking people's lives. It is not violating his rights at all to punish him for that choice.

I think we just disagree on the point where rights are infringed. Because you're talking about his money and fame as though they couldn't have helped him and didn't give him additional cause not to been the law. Let's agree to disagree mate. I'm sure we could argue this one for months

It would set an example to the young kids. Not an instant change, but a long term message that drink driving isn't right. That no matter who you are, you will be punished.

ve just thought. Courts DO already recognise financial resource as a factor in criminal proceedings with no cries of HR when it's done. It is not considered a HR violation of somebody wealthy is denied ball and remanded because his financial resources afford him the ability to pay for a private jet/yacht and flee the law's jurisdiction is it?

Not quite. A judge confiscates the passport of the accused. Our increases the amount needed for bail if the defendant is a flight risk.

However the courts do take notice of wealth, or community standing in sentencing because actually richer people are less likely to reoffend not more.

Really! I totally get no matter who you are you should be punished in the same way, however I don't buy sending Rooney down would make people think twice, you'd of thought the Lee Hughes incident would of made an impact on people! It obviously didn't make Rooney think twice about reoffending.

It doesn't matter if you look up to someone or not. All people are sentenced within prescribed guidelines for punishment with some leniency based on reoffending. The question you have to ask is Rooney likely to reoffend. And its very unlikely he will because he loses a lot of money/sponsorship every time someone even talks about it. Which is why he probably got a sentence in the lower end of the guidelines.

Its not about been looked up to mate, do you honestly believe some kid in the future would actually stop and think and remember Rooney getting sent down for drink driving (if he had like the op wanted) and then decide not to do it himself? I think on most occasions no.

Alcohol stops people from thinking straight at times and in Rooneys case the mixture of alcohol and getting his end away certainly stopped any reasonable thinking!

No, never good enough to play that far up pitch He kept a clean sheet and the prison side(some inmates) were very good. He came and took everything in the box with ease.
