More Everton Trouble?

Having just had a very harsh 10 point deduction, it seems Everton could face even more punishment with a potential further points deduction in months to come.

Everton face being forced into administration and given another nine-point penalty that would almost certainly relegate them if a second independent commission rules that other clubs should be compensated for their spending breaches.
Burnley, Leeds and Leicester are pressing ahead with plans to bring a compensation claim against Everton, which would be heard by another three-person panel appointed by the Premier League before the end of the season.

Everton's prospective buyers 777Partners have committed to providing around £20million-a-month to help with the club's running costs whilst the Premier League are assessing their takeover bid, but Mail Sport has learned that they would not be willing to pay a compensation bill that could run into tens of millions of pounds.


The deal agreed by Farhad Moshiri and 777 in September contains clauses stipulating that the sale price will be reduced significantly if Everton are instructed to pay compensation or relegated from the Premier League.

Everton's current regime lack the funds to settle a significant compensation bill, which would leave the club facing administration and the automatic nine-point penalty introduced by the Premier League in 2004.

While Sean Dyche's side are just two points from safety despite being docked 10 points on Friday, the loss of nine more points would almost certainly seal their fate.

In an interim hearing held before the independent commission was appointed last May David Phillips KC ruled that Burnley, Leeds and Leicester, whose claim was first revealed by Mail Sport, had a case.

'I am satisfied that the applicant clubs have potential claims for compensation,' Phillips wrote in a judgement published for the first time on Friday.

The three clubs are understood to be preparing a claim for £100m each based on the loss of Premier League income as all suffered relegated in seasons during which Everton have been found guilty of overspending, although such claims are seen as wildly optimistic. The amount of compensation to be paid would be decided by a second independent commission if they deem Everton to be liable.

Burnley, Leeds and Leicester have 28 days from Friday's judgement to formally lodge their claim, with the Premier League confident it will be heard before the end of the season, as will Everton's planned appeal against the 10-point punishment.

'Those claims and their validity depend on whether the complaint is upheld,' Phillips added in his judgement in May.

I’m still not sure they would go down with another 9 points off, that’s how bad the others down there are.

I think the bigger problem would be they would almost certainly have to sell their better players in the summer and have faaack all funds to buy with - imagine if they went down their first season in their new stadium - Everton that

I think Everton will be fine on this one. Not claiming to a legal expert but I know the basics anyway.

Essentially any of those clubs making a claim would have to prove to the courts that the additional £17m overspend, basically a drop in the ocean in the grand scheme of things, resulted in Everton obtaining the difference in points tally to stay up at the expense of the club making the claim.

I’d say that’s pretty much impossible personally would be surprised if any of them bother pursuing this once they’ve taken proper legal advice.

Could do point per pound spent the previous window on all Prem teams and average it - I agree Everton could tie it up for years establishing a “measure” but the teams interested in this will be very keen, even if it costs Everton in a later season as they are likely to remain rivals

Stopped reading at had a very harsh ten point deduction.
How is it very harsh? Cheaters got off easy.
Plenty of clubs have got worse, Everton lucky the bottom of the pl is so crap they could get thirty points off and probably survive.
Each case has nothing to do with each other so I don't see what Chelsea and city have to do with this. One case at a time but Everton got off easy.

This all just makes me hanker for the old days of clubs having modest finances, football wasn’t a business, players didn’t earn small fortunes per week, and the league wasn’t being sold around the world to the highest bidder for TV rights

Even if they got another 9 points they’ll probably stay up with how bad it is at the bottom of the table, this is the best season to get the point deductions
