CQN view of the Rangers situation

Not sure if anyone has seen this but its a pretty decent review of the situation and the actions that Whyte was adopting.

Ticketus are not a secured creditor.

Ticketus paid money to the Rangers FC Holding group, not the club.

As Whyte did not actually invest any money himself in the takeover, nor the club, and has apparently broken several terms of the SPA by doing so, he will likely NOT be a secured creditor.

Any 25pt penalty is complete fiction - there is nothing in any SPL rule to mandate such a penalty

IF Rangers go to NewCo, all liabilities are left with OldCo - that is the reason for doing so - this would include all money / debts in any fashion owed to anyone.

And as for the rest, could drive a division of tanks through the argument...

Most of it is very good. However, they have not taken into consideration that the Ticketus deal is not a loan, Craig Whyte actually sold these tickets. The amount Rangers supporters pay the club for their season tickets will see x amount go to Ticketus.

Whyte did invest money, whether it originates from his own wealth is irrelevant. He has taken money from the sale of assets and used it to meet to tick every box which would allow him to be a secured creditor.

You are only a secured creditor where you have secured your investment against assets of the company. As Whyte has NOT invested anything into Rangers, he cannot be a secured creditor.

As Ticketus did the deal with the parent company, which is not (yet) in admin, that is who has the contract with Ticketus.

And let's not even get into the trousering of the Arsenal share proceeds, the dodgy payments to the Banfield account etc etc.
