Hernandez shouldn't have been allowed to play(stop calling him by that ridiculous nickname, what are you? 7 year old) but obviously different rules apply for Utd.
You probably know this already, but the Emirates Cup is registered with FIFA as a competition and, therefore, its matches fall under the body's rules. Whereas, Man Utd's game last year must have been outside of FIFA's juristriction.
i dont know, wasnt part of the Chicharito deal an obligation for United to play Chivas?! maybe it was a symbolic sale of him at half time, so in the first half of the game he could legitimately play for Chivas as he was still contracted to them, then at half time he had signed for United, so could legitimately then wear their shirt and play for them.....
Henry is contracted to NY Red Bulls, so couldn't really turn out playing for another team.
Or maybe one is just a friendly game, but the EMirates cup is, in the eyes of Fifa, a competitve competiton, even if it is in pre-season. That would explain why testimonials often see players wearing one teams colours in one half and another teams in the 2nd half.
That is all just speculation btw, i have no real idea why, but would be curious to find out.

And if you haven't alkready noticed many people call him Chicharito, Hernandez, Chich, Chico, does it really matter.
As it was preseason I dont see what the problem is for old players to play for their old clubs, Henry or Hernandez.

Thanks for the sensible replies. I hadn't thought about it actually being recognised as a FIFA tournament, but i thought all professional games were supposed to be governed by FIFA?
I think your right about the Hernandez deal and its claus for us to play a friendly and him to play 1 half for each team

Yeah you're right about FIFA. All professional teams fall under their control. I don't think there is such a thing as FIFA jurisdiction.
Testimonials are not considered to be professional matches hence why you can have people changing sides, getting subbed off then back on etc

We also wanted to experiment with goal line technology for this years tournament but FIFA blocked this. So, your story checks out and you shall not be shot today.
