Its a cake. VAT is not paid on J a ffa Cakes as it was ruled in court that it is a cake. Hence the reason no VAT is paid.

This case hinged on the disparity between the treatment of cakes and luxury biscuits under VAT rules; while cakes are exempt from the tax, luxury biscuits are subject to VAT at the standard rate.
HMRC argued that Ja ffa Cakes were chocolate-covered biscuits, not cakes. Their size and shape, and the fact that consumers often ate Ja ffa Cakes in place of biscuits, were used to justify the imposition of VAT on the product.
However, McVities, the makers of Ja ffa Cakes, insisted that they were small cakes – and, according to rumour, even produced a giant Ja ffa Cake in court to help illustrate this point.
Ultimately, the tribunal ruled in favour of McVities. A similar judgement was made in favour of Marks & Spencer when they argued that marshmallow teacakes should not be subject to VAT.
Id like to point out I was one of the first to post it here and find it was a banned word.So in the spirit of a healthy lifestyle and as one of my five a day I now use satsumas!

I know the courts ruled it is a cake - However courts often get things wrong.

It may well be. The problem with context is that you can only determine it after the comment is made and often by that point(when used in the wrong context) the forum is an argumentative abusive headache!
It's a biscuit.
It's too small to be a cake and comes in biscuit packaging, and pretty much resembles a biscuit.
I think people are just getting mixed up because of the name...sort of a Claudio Gentile situation...
Strange thing is that the jelly is 70% apricot, so it's 2 of your 5 a day

Strettea, there's not much to it, but if you're interested check the Jeff Schlupp article on the Leicester City page.
It is a cake according to the courts - VAT is not payable on a J affa cake whereas it is on biscuits apparently.
However (also apparently) the majority of Sun readers thought it was a biscuit.
Better still, remove the letter E from the last word and a word best describing some of our recent performances will appear.
