what im saying is that the lady in question would be likely to be far less upset than the lady who was faked up the rrrs all night by the milkman who had told her he was a billionaire, but she would have a cause of action, whereas the duped woman would not.

where do you get that idea from ?

even if that is true (and I find it surprising that rape id definied by reference to 'conditions' which the parties had agreed upon), it is very unlikely that the woman would have said 'well ok then, you can fak me up the rrrr all night, so long as you take me out in your boat next week'. she would have just gone along with it on the assumption that if she puts up a good show, she will probably get an invite.
