the former - my dads ex (not my mum) is playing the good old you're not seeing your daughter card, he's on the birth certificate post december 1st 2003 so as far as I know he does have parental responsibilities so not sure how much of a case she has...she said take me to court and they'll say you have no chance but I think the judge will push for mediation....
Hmm. I used to be a qualified mediator. Never actually did any mediation though. It's kinda a crock of shíte in my opinion. Touchy-feely nonsense that can cause just as much harm as it can cure. I'm sure it works for some situations though.
Family law's not my bag though so I really don't know the answer... there's a few people from my law school who are doing family law but I don't think any have qualified yet so can't really recommend them...

problem with mediation (if memory serves) is that both parties have to go willingly and it's not legally binding.....that said if me old man pushes for mediation as a first step and she refuses then I guess if it goes to court he looks the more reasonable

It's amazing how different it is to full-on legal proceedings. Court cases are all about finding out the facts and weighing up hard evidence.
Mediation is literally all about chucking the facts out the window - no point in quibbling over facts since everyone has a different viewpoint - and just concentrating on how each other's behaviour has made you feel. The idea is to try and get each party to see things from the other's perspective.
It supposedly has a high success rate but as you say the outcome isn't legally binding. As far as I'm aware though in family cases it IS a legal requirement to try some form of alternative dispute resolution so I'm not 100% sure she'd be able to say no... at the very least she'd need to suggest another option I think.
I feel like I want to go round and have a word with her see what the craic is...but in doing so I don't want it to look like intimidation...me trying to do good could end up doing bad

Obviously free, I don't want to break the law incurring fees when I'm not qualified...
