Ched Evans: Rape conviction quashed

Speaking outside court Mr Evans's solicitor Shaun Draycott said: "Ched Evans is extremely grateful that the court of appeal has ruled that his conviction for rape was unsafe and should be quashed."

The striker's case was referred to the Court of Appeal by the Criminal Cases Review Commission (CCRC), which investigates possible miscarriages of justice in England, Wales and Northern Ireland, after new evidence emerged.
Lady Justice Hallett, Mr Justice Flaux and Sir David Maddison heard submissions over two days from Kieran Vaughan QC, for Mr Evans, and from Eleanor Laws QC, for the Crown.

Announcing the court's decision, Lady Justice Hallett said the judges heard "fresh evidence" during the appeal hearing on 22 and 23 March.
She said: "In summary, we have concluded that we must allow the appeal and that it is in the interests of justice to order a retrial."
The court quashed Mr Evans's conviction and declared: "The appellant will be retried on the allegation of rape."

Mr Evans and former Port Vale player Clayton McDonald admitted having s3x with the woman on 30 May 2011, but said it was consensual.
Mr McDonald was acquitted of rape at their trial at Caernarfon Crown Court.
Mr Evans has not been signed by a new club since his release from prison.

If the new evidence indicates he did nothing wrong he has the right to go back to court and be declared not guilty and have the media and people who discredit him know it.

The man served 2 and a half years in prison and lost 4 years of a short career.

Hopefully they will take the girl that made these false rape allegations to court so she can serve justice.

It was a completely a joke conviction. If getting drunk, having s£x and then regretting it in the morning is being raped then who hasn't been raped?

Ridiculous conviction and the media slammed him for protesting his innocence. Ruined the lads life

X amount coming out and saying just accept the decision, Jessica ennis threatening to have her name removed if sheff utd sign him.

Then there's people who will say no smoke without fire etc etc

How did they find him guilty in the 1st place

Why did she willingly go to his hotel with him at that time of night/morning ?

What was she expecting was going to happen ?

It all stinks of a stitch up to me.

The CCRC hasn't got any power to order a re-trial; that is the sole remit of the Court of Appeal. Clearly the 'new' evidence has had a bearing on the legitimacy of the original verdict by the jury, so, back it goes to trial. That's if the CPS are of the view, taking into consideration the new evidence and its impact, that there is still a reasonable liklihood of conviction. If not, or, say, prosecution witnesses don't want to go through with the trial again they may chuck the towel in.

Not having been a member of the jury, and not having heard all of the evidence in the trial in its entirety, I won't jump to the seemingly inevitable conclusion that he was or is 'a rapist skumbag' etc., I will let justice take its course instead.
