Scenario 1: The employer (THFC) wish to terminate the employees (Jose Mourinho) contract. As they are effectively the ‘controlling party’, they are able to do this, either by paying the remainder of the contract in full, or reaching a settlement.
Scenario 2: The employee (Harry Kane) wishes to terminate the contract, but the employer (THFC) does not wish to do so. As such, they are entitled to hold him to the terms of his contract for the duration of its term. Unless an agreement is reached which is acceptable to the employer in terms of compensation etc, they are under no obligation to end the contract.

So Spurs can say 'your contract means nothing' as far as Mourinho is concerned but then say 'you signed a cast iron contract, live with it' to Kane, talk about double standards.
Also Kane is well within his rights if there was a gentleman's agreement between him & Levy, especially if Levy had a 'reasonable offer' clause in it as £100m (reportedly offered by City) is a very reasonable offer in everybody else's eyes.
