He deserves a ban but the FA have no grounds to ban him on. If they ban him then they would have to ban every single player that makes a mistimed or dangerous tackle every week and they are never going to do that.

He was not unlucky, the players that suffer from these tackles and as you put it 'come away without a scratch' are VERY lucky. The Taylor tackle is the worst kind in the game, indefensible and will always result in a minimum 3 game ban. The tackle that Valencia broke his leg in was a 100% completely fair tackle which Valencia was unlucky to suffer an injury from.
