I think there is a free transfer deadline but I don't think that's until the end of the month. Doubt Sporting would terminate his contract though, but who knows.

Also if he became a free agent, I'm sure there would quite possibly be more high profile clubs looking to snap him up for free as well, sorry to say.

the fee I assume has been paid already?

its seems plausible as since he signed with Leicester sporting surely dnt have his contract anymore so its not up to them to terminate it down to Leicester, just like a few years bk when barce signed turan but couldn't play him for 6months so he had to wait, it seems like a loophole that might work but again im sure there's smarter people in football that may have explored this already

Yep. Did not see that one.

Unless the player has a clause to allow him to buy himself out of the contract (to the tune of £22m to be reimbursed in a new wage deal).

Leicester already signed him, so Sporting cannot release him as they don't have him.

The issue is in regards to registration not transfer.

So ultimately he's Leicester's player, just unregistered until January. Suppose that's the case settled then. Didn't know myself that if a deal isn't completed then the transfer goes through. I thought if you cannot complete a deal then Sporting still keep him. Didn't know it was just a case of registering him for the PL.

They could agree to mutually terminate the contract and in theory, if the window is open, he could sign as a free transfer but even free transfers need sanctioning by FIFA to play in FIFA affiliated competitions and I'm sure they would find something to prevent it being completed until January if they wanted to.

I was more baffled by the fact he 'hasn't been allowed to train with Leicester City'. I can't think of any ruling that would prevent him from playing football in training sessions at a privately owned facility!? I can only imagine that FIFA have requested he not liase with Leicester whilst the situation is being appealed against and Leicester City Football Club have been compliant with this in order to perhaps show 'goodwill'.

I mentioned this on another thread, in theory, the Premier League could allow Silva to play in PL fixtures, particularly with the backing of the FA, but there obviously could be consequences in relation to UEFA/FIFA regulated competitions as a result of this.

If it really got to deadlock, the court of arbitration would become involved, but hopefully something will be sorted soon.

Whilst it settles confusion on JA606, I'm not sure the case between Leicester and FIFA and resulting appeal was ever about the validity of the club/player contract (not sure they even get involved in that), but more rather, the time that Leicester state they submitted the details to the FA (who then submitted them on to FIFA through their transfer online system). I'm guessing the clubs' current stance is 'we sent the paper within the extended period' and 'it was the FA who forwarded it on late' - which I guess is why the FA are backing Leicester's case. FIFA's riposte has probably been 'well you should have taken into account the time for it to liaise via the FA'.

Well whoever's fault it is, FIFA do not seem inclined to change their decision. Best to just allow Silva train in the country at least though because as established, he's now a Leicester City player so they have to let him stay, he's just not registered at the moment.

Think you're right. Unless FIFA do a u turn any appeal to the COA is probably pointless as by the time the case is heard and sorted, even if successful, would be months.

I can understand FIFA's position on this. If they perceive the documents are late then does it really matter whether it's 1 second, 14 seconds, 10 minutes or 3 weeks?

If we do find a solution/loophole to push this through then great but, I think as a minimum, FIFA should find a way to be able to let Silva train with the squad if he's our player. Outside of the legalities and rights of wrongs of the issue there is a player who has been left in limbo, in a World Cup year, through no fault of his own.

Yeah, I think everything necessary has been said in the various comments above. This isn't going to get around the issue. The best way looks like launching an appeal as best they can and, if that fails, just having to wait until January.

It doesn't help Silva in the short term of course. He's the one to feel sorry for in all this.

Having worked closely in employement law, preventing someone from working isn't generally accepted in any profession. It's a breach of human rights.

If this did go to court, he would eventually play for us. However, that could create a very bad relationship between the club, FA and FIFA.

I hate FIFA. Disgusting and self protecting organisation that care little for the good of the game.

Does anyone know whether the registration issue also stops Silva from playing for the Development Squad? Keeping him match sharp for the next three months is going to be really tough if he can't play in games at any level. UTF
