It is explicitly written in article 3 of the UEFA Champions League regulations. For England (and other leagues with 4 entrants) it has to be the teams finishing in the top 4 positions of the top domestic championship.
The leagues get no say in this. The only allowances are for CL or EL winners who finish outside the top 4.

Yes and those play-offs would decide the best teams in the league for the leagues that have play offs (like Belgium). Since this is for situations where the league cannot be completed it is highly unlikely that leagues are going to then organise play off tournaments.
The sporting merit has to be objective and clear. It is going to be the teams that are in the top 4 once any mitigating factors (eg points per game) are applied.
Only the Prem title can be awarded by clear and objective sporting merit. The rest is debatable tbh.

European places should be handed out according to current standings, but no domestic titles awarded other than those that have already been completed.
