It's in a different context and isn't used to abuse or cause harm. So there is no offence.

Quite how a black person calling a black person the N word can be deemed as racist is beyond any common sense at all.
Black people addressing one another through the use of the N word has been widely documented, just listen to "gangsta" rap music and you'll catch my drift! To a non black it may seem odd but it is done because of the history of usage by colonial white "masters" who also dished out physical abuse. Blacks feel they have reclaimed the word and consider it acceptable to use it on one another in a stylistic way.
Pakistani Asians also do it to one another through the use of the P word. Like blacks they consider it socially acceptable, within certain quarters anyway.
However, a non black does not and historically has not used it in the same way. They usually use it as the the worst slight possible. They emphasise the negative connotation i.e. that their skin tone is greater than the victims. The intention is to be racist.
Personally I would prefer if people stopped making references to skin colour and judged one another on ability.

So it depends on the context. If a black person uses the n word in a derogatory manner against another black person then yes they are racist.

That footage of Evra is many years old btw. Only he knows. As I explained black people tend to take offence if it is uttered by a white person because of the history behind its usage.

By legal definition yes, but in practice nothing is made from it because as I said blacks have or think they have reclaimed the N word to their advantage. They consider calling one another by the N word socially acceptable.
