Redd, the only reason why I'd like to contest it rather than ignoring it as if a company is a member of the British Parking Association (BPA) they can obtain details of the registered keeper of your car through DVLA.

Now because the keeper of my car is a company my employer uses to give us lease/company cars, I don't want letters forwarded on to my employer as they have my reg. If I was the keeper of the car I would definitely have binned the notice by now. As far as I am aware contesting a charge is not admitting liability?

Put in in the bin and forget about it.

Next steps will be about 5-6 threatening letters and then they will stop.

I have done this on about 7 occasions, 3 in the same carpark.

If it's a council run car park pay up, if it's a traffic warden or police ticket, pay up.

If it's private car park, ignore it. It's nothing more than an invoice, it comes under contractual law and they would have to prove you agreed with the contract when parking. Google it or check out money saving expert.

Go back, take pictures of how badly signed it was, send all to them and tell them you will see them in court and have engaged some ambulance chasers

The above is right.

The moment they see pics that a judge will just say get out and stop wasting my time to they won't spend a cent on any chasing.

Screw them. Unless you knew what the penalty was and knowingly entered into the contract. it is not legally enforceable in any way.

Points to consider:

You will not be admitting liability by appealing. In the case of a private company issuing a parking ticket; the appeal process is undertaken internally. It is not carried out by an independent adjudicator. There is no likelihood that a private commercial business would chose to rule against itself during such an appeal hearing.

So the appeal process is bound to fail, but you must partake in the process in order to later satisfy a county court that you first exhausted all options.

The only legal recourse that this company will have will be via the county court process. They wont have the same powers or legal recourse as a council who issue tickets via the PCN. Only tickets issued by a local authority or charging authority are classed as PCN. Private companies often call their tickets PCN; but they don't have the same legal definition or recourse.

I'm not sure what your grounds for appeal would be, but you need to state your intention regarding the fine, and make it clear that you do not intend to pay. It will then be down to the issuing company to decide whether or not you are worth pursuing in the county courts.

Wait and see if a letter is sent in the registered owners name. If it is, then you follow the appeal process. All correspondence should be titled "Without Prejudice" and then state your intent. If you don't get a letter, then you are free and clear.

Private companies rarely if ever chase up parking tickets as most have no access to the DVLA database. This is largely due to the fact that they are not registered correctly to access this information; and most do not conform to the DVLA's strict regulations and code of practice.

If they take you to court; then you will need to satisfy a judge that in all probability the ticket was issued incorrectly or unfairly.

I hope this helps.

M is a liar, pay up first before they ship you off to Alcatraz

posted on 27/3/16

I forgot add that it will cost the issuing company £70 to take you to County Court; which they get back as costs if they are successful.

So its not really worth the risk on their part to spend £70 in order to pursue a debt of £60/£100, as they might lose the case and they would then incur your legal costs; which you can set within reason.

Firstly, they need to get your name and contact details from the DVLA, which as I mentioned is unlikely.

Alcatraz closed over thirty years ago. But I suspect there are small rodents living there that have an higher IQ than you Digby.

I also suspect the walls of Alcatraz to be cleaner than those of your mothers living room.

Happy Easter.

Thanks for that info M. The only other thing I am aware of is that if a company is a member of BPA, which I believe this company is, they can legally obtain my details from DVLA. As I am not the keeper of the car, is it worth letting the company keeper know to ignore any letters on my behalf?
