Looking at the Utd fans comments on here, if correct, I don't see how Cavani could possibly be getting a ban.
----------------------------------------------------------------------

Is that the part where several of us likened it to the Silva incident and expect him to get a one game ban?
---------------------------------------------------------------------
If they liken it to the Silva incident, he will get 3 games.

The problem is the scousers and press will try their hardest to compare this and the Suarez/Evra incident as like for like. When in reality, they are worlds apart.

Now he’s a match winner and looking like he could be an important player for Utd, they’ll come after him even harder.

I didn't say it was, my point was that the one game ban that SIlva got is completely irrelevant.

Anyone who is comparing it to Silva is by extension saying it'll be a 3 game ban due to new rules introduced this season.

posted on 30/11/20

Just to be clear, I don't think it's the same as the Silva incident and debated as much yesterday.

But I do think the FA are more likely to use that rule and charge against Cavani than any other.

Except I don't think that's the case at all - the rules this season were not linked to that FA rule or charge from what I can see.

If they're interpreting "discriminatory abuse" as *any* statement which includes *any reference at all* to nationality, for example, they'd have to ban literally everyone and shut the game down

You'd have to disband international football, wouldn't you?

.....

It wasn’t a tweet.

Hope this helps.

look leaving rights and wrongs aside.

We all know the FA make it up as the go along to suit whatever flavour of the month is.

The FA will indeed as stated make sure it looks good coming out of it.

When in the end you have players kneeling at the start of games etc etc then sorry but if an honest mistake or whatever has to equal a ban or it looks like double standards.

the simple way to deal with this is to establish facts, make a statement of "he didn't mean it guv" slap a quick 3 match ban on and be doe with it.

I can see the line being he's not a racist but he shared something that is racist or what have you.

then we all move on with our lives.

for the record there is obviously a scale of issue here so I fail to see who the suarez incident has much of anything to do with this.

the silva one showed clearly a total lack of awareness on his part and probably no small amount on unconscious racism as well. the "woke" amongst us might see that irrespective of what was common in childhood the image was wrong.

Cavani clearly has an issue in what he's done as he's used a term that been proven within the context of speaking to a friend so again clearly he's not "woke" enough to realise it.

slap on 3 matches and lets all then get back to kneeling without doing anything about the real issues.

They've done almost like a 6 degrees of separation thing -

They've stated that anything that constitutes discrimination is an automatic 3 game ban, and then been extremely loose in their definition of discrimination in order to give them as much control as possible.

They could very well determine that it doesn't fit the bill, and he might receive nothing at all.

But, if they determine that he has breached a rule then it'll be 3 games.

Fair comment, but having read their press release I just don't see the link with the charge that Silva got.

I may well be wrong but I thought it related to something different tbh.

hes fresh of the boat retweeted something that's offensive in this country but the opposite in his own, someone told him that and he deleted the post, sounds a bit more reasonable

Silva got E3 I think which is just standard abusive language (I think?). Don't think they had the nuance in their guidelines last year for this kind of stuff.

Honestly, no idea. MITO is right, they're going to do whatever they want anyway.

This was Silva's:

FA Rule E3(1), as it was insulting and/or improper and/or brought the game into disrepute, and constituted an “Aggravated Breach”, which is defined in FA Rule E3(2), as it included reference, whether expressed or implied, to race and/or colour and/or ethnic origin.

I just think it's a stretch to link that to discrimination, but as you say, they'll do whatever they want.

posted on 30/11/20

They also have to consider the backlash. Whilst I completely agree that this is totally different from the Suarez situation and shouldn't be used as precedent, you will (as this thread shows) get some rival fans shouting loudly about it being the same word and Cavani getting off. This has every chance of being exacerbated by media outlets looking for a headline that will generate clicks and could end up being awkward. Not saying that I I think such a backlash would be warranted or appropriate but just that it could happen.

It may influence the FA to ensure they are seeing as being fair and stamping out all forms of potential racism. They can just claim that they want to send a message that using such terms is not approved and that kids who see it might think it is acceptable.

posted on 30/11/20

I think us United fans are grown up enough to accept any punishment Cavani gets as long as it's consistent with FA rules.

And for context, here is the FA's definition of discrimination:

FA Rule E3.1 sets out various obligations regarding a Participant’s behaviour. A breach of Rule E3.1 is
considered “Misconduct”. Acts of discrimination are considered to be amongst the most serious type of
Misconduct which a Participant can commit. For this reason, any act of discrimination is considered to
be an “Aggravated Breach” of E3.1. An “Aggravated Breach” is defined as a breach of Rule E3.1, where
it includes a reference, whether express or implied, to any one or more of the following: ethnic origin,
colour, race, nationality, religion or belief, gender, gender reassignment, sexual orientation, or
disability.

Context is always important but I do think the FA needs to make an example of Cavani too even if it is just a one game ban.

posted on 30/11/20

There's definitely a ban incoming - just depends on the amount.

Not relevant to Suarez though.

Good to see this turn into a sensible discussion despite the odd few trying to turn this into something else.

How they sort it out quickly tbf if it’s a 1 game ban and he misses the West Ham game rather than the City one.
