"Yes she may not recall consenting or not but there was obviously significant doubt that she was incapable of doing so. "

Significant doubt does not = "beyond reasonable doubt".

I get your point about McDonald not being done, but if Evans turned up and said "alright love, fancy letting me have a go" and she said "yes" - irrespective of how morally abhorrent it is - he (may have) got permission... Only Evans, McDonald and (perhaps) the girl know.

Robben,

It's the nature of the crime, the criticism that Evans' is somehow being hard done by, the implication that she was 'asking for it' despite a unanimous verditc, despite the denial of appeal..

It's crass in my opinion, why if you think there's a fair chance he might have raped her put forward arguments for his apparent innocence so vigorously? It doesn't make sense to me.

I'm not vigorously arguing his innocence; he may well be guilty, he may not - nobody (except the 3) know the truth.

Oh... I didn't write that

"No matter what the charge or where the trial, the principle that the prosecution **must prove** the guilt of the prisoner is part of the common law of England and no attempt to whittle it down can be entertained."

Yep, maybe the mates know too.

Yes, there is a fair chance, but I also believe there is a fair chance that she consented.

If she didn't know what was happening (i.e unconscious) then that is rape, yes.

Not at all, it's just come up recently and, obviously, been discussed a lot on here... I didn't know about it when he was convicted and, as I've said many a time, I don't have any interest in Evans in particular hence I didn't have an "outcry" then

The judge instructed the jury that the victim may still have been unconscious and unable to give consent. I keep fogging the horse because details like that are important and keep getting missed.

Enjoy the game

May. May. May. May.

Nobody knows, which is the point we are making.

There are similarities Cal, but with this one there is a video - which obviously proves the case. Also the pervy hotel workers were watching too.
