So we are to simply disregard the version of events reported by each and all, and consider an alternative (unsubstantiated opinion) in its place?

IMO this matter will never see a courtroom and a private settlement will be arranged.

Let me clarify.

When you have each and every media outlet in the country all reporting the same/similar version of events, (without debunk) is it not reasonable to give the information some recognition?

But what information are you on about.

It not open to question what happened and that Jose should not have critised them, but at the same time every media outlet in the country seems to be ignoring the fact this incident involved 2 people its all about Eva because she was high profile and it makes easy headlines.

No one is questioning the version of events, just how strong her case is.

I assume as there is little dispute in regard to the version of events, Eva might therefore have a strong case for constructive dismissal?

I understand that a dramatic 'changes of duties’ is grounds to sue for constructive dismissal.

How has there been a dramatic change of duties?

She was team doctor and did remain team doctor, the only difference was she was no longer on the bench, a position for which she was not entiled too (this has been confirmed in many media stories)

No doubt Eva will get herself a good job out of all this, could be good publicity for a club to take her on after all this fall out.

She was demoted because "she lacked knowledge of football" according to Jose. In other words HE knew Hazard was cheating by staying down when he wasn't injured but she didn't..... interesting

Further to JM's public criticism of her, Eva was:

* Removed from the bench on match days.

* No longer permitted to attend training sessions,

* nor to enter the team hotel.


All duties she had performed (for a number of years) prior to JM public criticism.

Eva had been acting as CFC first team doctor since 2009. She was an ever present at pitch side.

After the incident, she was downgraded.

I don't. The link provided was one of many reporting the same version of events. To date (and to my knowledge) there have not been any reports offering a opposing view?

Why does there have to be a victim? There are changes to staff at clubs all the time, because there is a woman involved all of a sudden we have a victim. And what about the male involved, why does everyone seem intent on ignoring him in all of this?

Because ignoring Jon Fearn allows people to make a much bigger story of it than it actually is and let's be honest it's a total non-story anyway.

I bet most fans of any club wouldn't even be able to tell you who their club doctor or physio even were and this story has so little to do with actual football anyway.

It's simply a childish opportunity for people to point score against Jose and the club.

The Football Medical Association has since confirmed:

"The FMA is extremely disappointed that Dr Eva Carneiro will not be resuming her full duties as first team doctor at Chelsea Football Club.

"As the representative body for medicine and science personnel in the professional game, the FMA aims to protect the rights of its members.

"Having recently been contacted by Eva, we have offered our full support in attempting to negotiate a satisfactory outcome.

"Unfortunately this has not resulted in our preferred outcome. Chelsea considers this now to be an internal matter and it is for Chelsea and Eva's appointed lawyers to discuss any further action."



Eva obviously resigned however this is a case (assuming it proceeds) of constructive dismissal. In that CFC’s actions left her no option but to seek employment elsewhere.
