It doesn't matter it the act was provoked/not.
It does tho. When Defoe bit Mascherano,he'd been taken from behind (he doesn't enjoy it like Toor and Terminator). So even tho I don't agree with what he done,there was reasoning behind it. There was no such provocation from Branislav,which makes Suarez a fooking screwball.

1. A. Footballer is found guilty of rape & given a suspended sentance. He is the star of A. Club FC
2. This action is deemed as a fundamental breach of contract and the board weigh up the option to terminate the contract. They don't have to terminate his contract, it is just an option.
3a. A. Club FC know that terminating the contract will cost them £Xm in the resale value of their asset
3b. A. Club FC are in the play offs and need A. Footballer as he is the only fit striker, and the star of the show
3c. A. Club FC know that not terminating the contract will mitigate both of the above risks, but may harm their reputation
4. A. Club FC opt not to terminate the contract of A. Footballer
5. A. Club FC are subsequently judged by the fans and media for their decision to employ a rapist, and face massive backlash.
Now, it wouldn't take a rocket scientist to anticipate that step 5 would follow step 4. Ergo, the club take into consideration how damaging THEIR actions could be during the proceedings and do in fact consider their own morality at around step 2. The board do not want to appear immoral in their decision, nor do they want the decision to cost a fortune. Balancing morals (i.e. endearing yourself to the fan base) with the financial cost (i.e. how much money this costs) are two big factors.
If you fail to understand now, you have either never studied law or worked in it - or you are unsuccessful.
